1. Acceptance of Terms
By creating an account, placing an order, or using any service provided by RiftLayer (“we”, “us”, “our”), you (“you”, “customer”, “client”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you may not use our services.
These Terms apply to all services we offer, including but not limited to game server hosting, dedicated servers, virtual servers, web hosting, and any related add-ons or management services (collectively, the “Services”).
2. Eligibility & Accounts
You must be at least the age of majority in your jurisdiction (typically 18 years old) to open an account with RiftLayer. By using our Services, you represent that you meet this requirement, or that you have the consent and supervision of a parent or legal guardian.
You are responsible for:
- Maintaining accurate and up-to-date contact and billing information.
- Keeping your login credentials confidential.
- All activity that occurs under your account, whether authorized or not.
If you believe your account has been accessed without authorization, you must notify us promptly.
3. Services We Provide
RiftLayer provides infrastructure services designed primarily for hosting game servers and related workloads. Unless explicitly stated otherwise, we provide unmanaged infrastructure: you are responsible for configuring and maintaining the software running on your service.
We may add, modify, or remove service offerings over time. Any material changes affecting your existing service will be communicated through email, your client area, or our status/announcement channels.
We reserve the right to decline or cancel any order at our discretion, including but not limited to suspected fraud, abuse, or technical constraints.
4. Orders, Billing & Refunds
All prices are listed in the currency shown at checkout and are subject to change at any time. Recurring services are billed in advance for the chosen billing cycle (e.g., monthly, quarterly, yearly).
4.1 Billing & renewals
- Invoices are typically generated prior to the renewal date of your service.
- Failure to pay by the due date may result in suspension or termination of your service.
- It is your responsibility to ensure payments are made on time; we are not responsible for data loss due to non-payment.
4.2 Refunds
Our refund policy (if any) is described on our website or during checkout. Unless explicitly stated otherwise:
- Setup fees, domain registrations, licenses, and custom services are non-refundable.
- Prepaid billing periods are generally non-refundable once service has been activated, except where required by law or explicitly offered as a satisfaction guarantee.
- Chargebacks or payment disputes may result in immediate suspension or termination of all associated services.
5. Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You are responsible for the content, software, and activities hosted on or originating from your services.
Prohibited activities include, but are not limited to:
- Hosting or distributing malware, ransomware, or other malicious code.
- Engaging in or facilitating DDoS attacks, port scanning, or network abuse.
- Sending unsolicited bulk email (spam) or running mail lists without proper consent.
- Hosting content that is illegal in the United States or in your own jurisdiction.
- Infringing on intellectual property rights or distributing pirated content.
- Running stress testers, booter / stresser services, or similar tools.
- Using the Services in a way that interferes with other customers or the network.
We reserve the right to suspend or terminate services that violate this Acceptable Use section, with or without prior notice, depending on severity and urgency.
6. Uptime, Maintenance & SLA
We aim to provide stable, high-availability infrastructure. However, no hosting provider can guarantee 100% uptime.
From time to time, we may perform scheduled maintenance that may result in temporary service interruptions. Where possible, we will schedule maintenance during off-peak hours and announce it in advance through our status page or client communications.
Any Service Level Agreement (SLA) or uptime credits, if offered, will be documented separately on our website or in your order details. SLA credits (if applicable) are your sole and exclusive remedy for downtime.
7. Data, Backups & Security
You are responsible for maintaining up-to-date backups of your data at all times. While we may offer backup features or snapshots as a convenience, these should not be considered a substitute for your own backup strategy.
We take reasonable measures to secure our infrastructure, but:
- No system can be guaranteed 100% secure or immune from compromise, attack, or data loss.
- You are responsible for securing any software, plugins, mods, or custom code running on your services.
- You should use strong passwords, enable available security options, and keep your software up to date.
We are not liable for data loss, corruption, or unauthorized access arising from your configuration, software vulnerabilities, or failure to maintain reasonable security practices.
8. Suspension & Termination
We may suspend or terminate your Services, with or without notice, if:
- You fail to pay invoices when due.
- You violate these Terms or our Acceptable Use policies.
- Your use of the Services poses a risk to our infrastructure or other customers.
- We are required to do so by law or by a court/authority with jurisdiction.
In the event of termination for cause (e.g., abuse or illegal activity), refunds are generally not provided. In all cases, we are not responsible for any loss of data or business arising from suspension or termination.
9. Disclaimers & Limitation of Liability
9.1 No warranties
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2 Limitation of liability
To the maximum extent permitted by law, RiftLayer, its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Services.
Our total aggregate liability to you for any claim related to the Services shall not exceed the amount you paid to us for the Service affected by the claim during the three (3) months immediately preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless RiftLayer and its owners, employees, and contractors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Services.
- Content or software hosted on your services.
- Any violation of these Terms or applicable law by you or your users.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and may provide additional notice via email or your client area.
Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Services.
12. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States of America, without regard to its conflict of law principles (you can change this to match your actual business location).
Any disputes arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of such courts.
